The Board of Directors of the Better Business Bureau in Southeast Texas has revoked the BBB Accreditation of Walker’s Electric Company of Beaumont. The revocation was approved by the BBB Board at its November 17th meeting.
The BBB Accreditation revocation for Walker’s Electric Company of Beaumont was due to the businesses failure to comply with the BBB Code of Business Practices Standards for Accreditation #1C and 3A.
On October 20, 2009, the Texas Department of Licensing and Regulation posted on their website final orders listing that Calvin Gary Walker, Owner of Walker’s Electric Company was assessed an administrative penalty in the amount of $5,000 and his master electrician license 75738 was hereby surrendered. Basis for Order stated that Mr. Walker falsified information on his application.
The Better Business Bureau works closely with the Texas Department of Licensing and Regulation and requires accredited businesses to be in compliance with their regulations. In addition, the Better Business Bureau respects orders listed by this state agency. Thus, determining Walker’s Electric Company has failed to comply with Code of Business Practices Standards for BBB Accreditation #1C which states “BBB Accredited Businesses will establish and maintain a positive track record in the marketplace and honestly represent products and services, including clear and adequate disclosures of all material terms.”
The section of the Code in reference continues by requiring that a BBB Accredited Business “be free from government action that demonstrates a significant failure to support BBB ethical principles in marketplace transactions (this requires a determination by BBB as to the nature of any violation, whether it was caused or condoned by management, and actions taken to resolve underlying issues that led to the government action).” Section 3A addresses that “a BBB Accredited Business must honestly represent products and services, including clear and adequate disclosures of all material terms by making known all material facts in both written and verbal representations, remembering that misrepresentation may result not only from direct statements but by omitting or obscuring relevant facts.”
Per the Better Business Bureau by-laws, Walker’s Electric Company may appeal the decision by notifying the Board Chairperson in writing prior to the next regular board meeting so that an appeal may be presented at that time.
“Businesses who apply for BBB Accreditation must have a BBB Ratings of at least a B, meet the eight standards in the BBB Code of Business Practices and must maintain those standards to continue their BBB Accreditation,” said BBB President/CEO Michael Clayton.
